Inter partes

Inter partes is a Latin term meaning “between the parties.” It describes a court hearing where both sides are present, represented, and able to respond to each other’s arguments before a decision is made.
This is the normal way most court matters proceed. It differs from an ex parte hearing, which is one-sided and used only for urgent, temporary orders.
In a scam case, an inter partes hearing often follows an ex parte freeze order. The party whose account was frozen gets the chance to explain their position, and the court then decides whether the order should continue.
When it matters
An inter partes hearing is where the substance of a dispute is properly tested, since both sides can present evidence and challenge the other’s account of events.
